What Is an Expungement?

Also called expunction, expungement is the legal process of removing a charge or conviction from a person’s criminal record. This process also seals or destroys the state’s records of your arrest and subsequent trial. After an expungement, therefore, it will be as though you were never charged or convicted. Even in a future court case, you can legally deny that the charge or conviction happened.

What Crimes Can Be Expunged?

Unfortunately, North Carolina has a range of statutes that govern the scope of expungements. Some statutes allow you to only expunge a certain type of crime, while others allow you to expunge many different types of crimes but only if you committed them at a young age. Statutes also differ in how long you have to wait before filing for expungement and whether you can expunge multiple crimes at once.

How to Get Your Record Expunged

To expunge one or more charges or convictions, you will need to file the appropriate petition, and each type of expungement has different instructions and requirements. You may, for example, need to include an affidavit of good character signed by people who know you. You may or may not need to obtain a judge’s signature or attend a hearing.

Generally, you will need to pay a $175 filing fee for your petition. You might not need to pay this fee, however, if you are expunging a charge that resulted in a “not guilty” verdict.

The entire process may take several months. If the court denies your request, you may be able to file an appeal, but you will likely have a very short window to do so.
