National Interest Exemption for Entry to the United States

Oakhurst Legal Group obtains yet another National Interest Exemption for entry to the United States for world renown marathon runner, Thomas Eller. Thomas Eller is an inspiration to track and long distance running fans from all over the world. Thomas Eller was born Deaf and has faced many obstacles to become a member of the German National Paralympic long distance team. 


COVID-19 Restriction Travel Ban for Athletes and Coaches


Due to COVID-19 travel restrictions, athletes and coaches from most of Europe in the Schengen region, cannot come directly to the United States. They are subject to a 14 day stay in another country to obtain entry to the United States, until the travel restriction is lifted. Unlike other professions, athletes and coaches cannot obtain or apply for National Interest Exemptions (212(f) waivers) at the consulate in their local area. These persons can only obtain NIE from the Office of Field Operations Customs and Border Protection Coronavirus Coordination Cell (“OFO CBP CCC”) and they only issue waivers for approved sports leagues. 


212(F) Waiver for Athletes and Coaches


Fortunately, the United States Olympic and Paralympic Committee (“USOPC”)  is an approved sports league and will take requests for waivers. We were able to prepare the documentation and coordinate a waiver request between the German Olympic Committee and the USOPC.


Thomas Eller was able to obtain his waiver within 4 days after the request to obtain a multi-entry one year waiver to the United States. He used this exemption to compete in the Boston Marathon.
